Rodolfo Hernández entuteló al CNE y a la Procuraduría para recuperar su candidatura a la Gobernación de Santander.

El equipo de abogados solicitó que se imponga una medida cautelar cuando antes para que el excandidato pueda retomar la carrera política de inmediato.

El excandidato presidencial Rodolfo Hernández cumplió su promesa de “usar los medios legales” y “luchar hasta el final” por sus aspiraciones políticas.

Horas después de que el Consejo Nacional Electoral revocara su candidatura a la Gobernación de Santander, el equipo de abogados que lo defiende interpuso una acción legal que busca devolverle la candidatura a Hernández.

Tal como se conoció este viernes, se trata de una acción de tutela en contra del CNE y de la Procuraduría General de la Nación que fue radicada ante el Tribunal Administrativo de Cundinamarca.

“Estamos reclamando la aplicación de la jurisprudencia de la Corte Constitucional, del Consejo de Estado y de la Comisión Interamericana de Derechos Humanos”, dijo Julio César Ortiz, uno de los apoderados del exalcalde de Bucaramanga.

Según él, la revocatoria de la candidatura “es un despropósito del Consejo Nacional Electoral en la medida en que no está en firme ninguna de esas sanciones”.

Con esto último, el jurista se refirió al argumento central por el que el Consejo Nacional Electoral decidió retirarlo de la carrera por la Gobernación de Santander.

Según argumentó la entidad, Rodolfo Hernández tiene por lo menos tres graves sanciones ante el ministerio Público: una por golpear a un concejal, otra más por presunta persecución laboral a Wilson Motta, y una última por agredir verbalmente a un veedor ciudadano.

“We are demanding the application of the jurisprudence of the Constitutional Court, the Council of State and the Inter-American Commission on Human Rights,” said Julio César Ortiz, one of the representatives of the former mayor of Bucaramanga.

According to him, the revocation of the candidacy «is an absurdity of the National Electoral Council to the extent that none of these sanctions are firm.»

With the latter, the jurist referred to the central argument why the National Electoral Council decided to withdraw him from the race for the Governor of Santander.

According to the entity’s argument, Rodolfo Hernández has at least three serious sanctions before the Public Prosecutor’s Office: one for hitting a councilman, another for alleged job persecution of Wilson Motta, and a final one for verbally attacking a citizen observer.
