UNA CORTE SUPREMA INEFICIENTE

Y UNA FISCALÍA POLITIZADA.

La Corte Suprema de Justicia de Colombia está compuesta por 23 mgistrados.

Desde el 2 de agosto de 2023, el presidente de  República entrego ante esta honorable Corte la terna para la elección de la nueva fiscal general de la nación.

La terna fue integrada por las abogadas: Ángela María Burgos Ruiz, Amelia Pérez y  Para Ampro Cerón Ojeda.

Realmente no está reglamentado el plazo para elegir el fiscal, excusa que casa al dedo para ser eneficiente: necesitaron 7 meses desde que se entregó a la Corte Suprema las hojas de vida, para poder tomar  una decisión.

Será que en una empresa privada moderna y competitiva se pueden dar estos lujos.

La respuesta es obvia, la eficiencia exige prontitud  dentro de lo racional.

Pero se ha vuelto costumbre  de este órgano judicial  demorar el nombramiento del fiscal.

Para el ordenamiento de la nueva fiscal, la Corte tuvo más de 200 días, para el nombramiento de Barbosa se demoraron 202 días y para el de Eduardo Montealegre 88 días.

Es un mal endémico sin justificación que debe corregirse dentro de ese marasmo que exaspera con la justicia colombiana.

La Corte tiene una pésima imagen entre los colombianos, llegando a veces a ubicarse en el 80% o más de imagen negativa, según encuestas de invamer y la del fiscal ha llegado hasta más del 60% de desfavorabilidad.

Pero nada de lo anterior los ajusta o los motiva mejor.

The Supreme Court of Justice of Colombia is made up of 23 judges.

Since August 2, 2023, the President of the Republic submitted to this honorable Court the shortlist for the election of the new attorney general of the nation.

The shortlist was made up of the lawyers: Ángela María Burgos Ruiz, Amelia Pérez and Para Ampro Cerón Ojeda.

The deadline for choosing the prosecutor is not really regulated, an excuse that fits perfectly to be efficient: they needed 7 months from when the resumes were delivered to the Supreme Court, to be able to make a decision.

Maybe in a modern and competitive private company these luxuries can be afforded.

The answer is obvious, efficiency requires promptness within the rational.

But it has become the custom of this judicial body to delay the appointment of the prosecutor.

For the appointment of the new prosecutor, the Court had more than 200 days, for the appointment of Barbosa it took 202 days and for that of Eduardo Montealegre 88 days.

It is an endemic evil without justification that must be corrected within that morass that exasperates the Colombian justice system.

The Court has a terrible image among Colombians, sometimes reaching an 80% or more negative image, according to invamer surveys, and the prosecutor’s has reached more than 60% unfavorability.

But none of the above adjusts or motivates them better.
