El presidente Gustavo Francisco Petro Urrego, sorprendió al país con un anuncio que sacudió  el panorama político: El gobierno convocará una consulta popular para que los colombianos decidan sobre la reforma laboral y de salud, tras el intento de archivo en el Congreso.

“Que sea el pueblo el que decida”, dijo el mandatario en una alocución, dejando claro que su administración no permitirá lo que él considera un bloqueo institucional por parte de la oposición  en el Legislativo.

El anuncio llega luego  de que ocho senadores e la Comisión Séptima firmaran una resolución para archivar la reforma laboral, lo que para el presidente representa una jugada para frenar los cambios  que su gobierno impulsa.

“Nosotros creemos que es el pueblo al que le toca decidir.

La manea como la Constitución permite que el pueblo decida  directamente se llama consulta popular”, afirmo el presidente, señalado que su propuesta busca salir el freno que, según él, han impuesto los sectores de oposición en el Congreso.

Lo que implica según la ley, una consulta popular es un mecanismo de participación ciudadana donde los ciudadanos votan Sí o No, sobre una decisión de interés aioal.

Sin embargo, su convocatoria requiere la aprobación del Congreso y el respaldo de todos los ministros.

Si se aprueba, la votación debe realizarse  en una plazo máximo de cuatro mees y solo será válida si al menos un tercio del censo electoral participa y la mayoría de los votos son afirmativos.

El pronunciamiento del presidente enero una fuerte reacción en el Congreso.

Iván Neme, presidente del Senado, no tardó en responder: “Respete al Congreso y deje de amenázanos, en alocución a la advertencia del presidente de la República  sobre una “ruptura su parte, los senadores”, con el Legislativo si sus reforman continúan  siendo bloqueadas.

Por su parte los senadores que impulsan el archivo de la reforma laboral argumentan que la propuesta del Gobierno afectarán la economía y la generación de empleo, por lo que consideran que la mejor opción es debatir alternativas viables en el Congreso y no forzar su aprobación vía consulta popular.

El camino para realizar la consulta popular no será fácil, presidente debe presentar la solicitud ante el Congreso y obtener su aprobación, lo que podría generar un nuevo pulso entre el Ejecutivo y el Legislativo.

Además,  en caso de ser aproada , se necesitaría  una intensa campaña para que la votación  alcance el umbral necesario.

President Gustavo Francisco Petro Urrego surprised the country with an announcement that shook the political landscape: The government will call a referendum for Colombians to decide on labor and health reforms, following an attempt to shelve them in Congress.

«Let the people decide,» the president said in a speech, making it clear that his administration will not allow what he considers an institutional blockade by the opposition in the legislature.

The announcement comes after eight senators from the Seventh Commission signed a resolution to shelve the labor reform, which the president sees as a move to halt the changes his administration is pushing for.

«We believe it’s up to the people to decide.

The way the Constitution allows the people to decide directly is called a popular consultation,» the president stated, noting that his proposal seeks to overcome the impediment that, according to him, opposition sectors have imposed in Congress.

According to the law, a popular consultation is a mechanism for citizen participation where citizens vote Yes or No on a decision of national interest.

However, its convening requires the approval of Congress and the support of all ministers.

If approved, the vote must be held within a maximum period of four months and will only be valid if at least one-third of the electorate participates and the majority of votes are affirmative.

The president’s statement sparked a strong reaction in Congress.

Iván Neme, president of the Senate, was quick to respond: «Respect Congress and stop threatening us,» in response to the President of the Republic’s warning about a «rupture on your part, the senators,» with the Legislature if his reforms continue to be blocked.

For their part, the senators pushing to shelve the labor reform argue that the government’s proposal will harm the economy and job creation, so they believe the best option is to debate viable alternatives in Congress and not force its approval via referendum.

The path to holding the referendum will not be easy; the president must submit the request to Congress and obtain its approval, which could generate a new standoff between the executive and legislative branches.

Furthermore, if approved, an intense campaign would be necessary to ensure the voter reaches the necessary threshold.
