SUSPENDE COSTRUCCIÓN EN

RESERVA NATURAL EN PEREIRA.

Luego de que la Procuraduría General de la Nación interpusiera una acción de cumplimiento, el Consejo de Estado confirmo en segunda instancia, la sentencia para la protección del Distrito de Conservación de Suelos Barbas Bremen, reserva natural de Pereira, frente a la consideración de la construcción de un proyecto condominio

La decisión del Alto Tribunal se dio luego de la acción popular promovida por el ente de control,  que pedía preservar el área protegida luego de que la Cárder Corporación Autónoma Regional de Risaralda y el Municipio de Pereira autorizará la realización  de un conjunto de casas campestres , proyecto condominio Campestre los Pinos- Santa Helena, al interior del área protegida.

En el fallo también se advierte que, las corporacionea autónomas no pueden alegar el cumplimiento de las regulaciones  ambientales por la falta de publicaciones de los actos administrativos , ni aseverarse que ciñen a la verificación de la estación  adelantada por otras autoridades, como en este caso, las procuradurías  urbanas;  y que tampoco los derechos  adquiridos  pueden prevalecer sobre la protección del medio ambientes.

Finalmente, el Tribual encontró sustento en los argumentos presentados por la Procuraduría  y las actuaciones judiciales para la protección de los derechos colectivos  y la biodiversidad de manera  diferente y oportuna.

After the Attorney General’s Office filed a compliance action, the Council of State confirmed in the second instance, the ruling for the protection of the Barbas Bremen Soil Conservation District, a nature reserve of Pereira, against the consideration of construction of a condominium project

The decision of the High Court came after the popular action promoted by the control entity, which asked to preserve the protected area after the Cárder Regional Autonomous Corporation of Risaralda and the Municipality of Pereira authorized the construction of a group of country houses, Campestre los Pinos- Santa Helena condominium project, inside the protected area.

The ruling also notes that the autonomous corporations cannot claim compliance with environmental regulations due to the lack of publications of the administrative acts, nor assert that they adhere to the verification of the station carried out by other authorities, as in this case, urban prosecutors’ offices; and that acquired rights cannot prevail over environmental protection either.

Finally, the Court found support in the arguments presented by the Attorney General’s Office and the judicial actions for the protection of collective rights and biodiversity in a different and timely manner.
